Personal Data Processing Notice (Privacy Policy)

1. Data Controller

The Data Controller is VoiSmart S.r.l., with registered office at Via Benigno Crespi 57, 20159 Milan (MI), Italy, VAT number 12343980152 (“VoiSmart” or the “Controller”).

2. Data Protection Officer (DPO)

VoiSmart has designated a Data Protection Officer (DPO), who may be contacted at voismart@sgst.it or through the “Privacy request” form available on the website.

3. Scope

This notice covers the processing carried out through the voismart.it website, in its Italian and English versions (the “Website”). It does not apply to third-party websites reachable through links, nor to the processing carried out through the platforms and services that VoiSmart supplies to its customers (for example PBX, guest Wi-Fi and captive portal, indoor navigation, omnichannel platform and virtual assistants): for those services, specific notices are provided by the party acting as data controller.

4.1 Browsing data

The IT systems and software procedures used to operate the Website acquire, in the course of their normal operation, certain data whose transmission is inherent in the use of Internet communication protocols: IP address, date and time of the request, URL of the resources requested, request method, server response code, response size, referring page, browser type and operating system. These data are used to ensure the proper functioning and the security of the Website (for example, preventing unauthorised access and cyber attacks) and to produce aggregate statistics on the use of the Website.

4.2 Contact, information and demo requests

Through the “Contacts”, “Request more information” and “Book a demo” forms, the following data are collected: name, e-mail address, company, number of employees and content of the request; for demo bookings only, the telephone number and the product or solution of interest are also collected. The data are used solely to respond to the request, arrange demonstrations and prepare any commercial proposals requested. Fields marked as mandatory are necessary in order to act on the request; if they are not provided, no reply can be given.

The forms are intended for commercial enquiries, partnership enquiries and general information. Technical support requests must be submitted through the support partner or the dedicated technical channel.

4.3 Job applications (“Career”)

Through the form in the “Career” section, the following data are collected: first name, surname, e-mail address, subject, message, curriculum vitae and any attachments, processed for the sole purpose of assessing the candidate’s profile in relation to open or future positions. Candidates are asked not to include irrelevant data in their CV, in particular data concerning health, political opinions or religious beliefs. Where the candidate discloses membership of a protected category (Italian Law No. 68/1999), the processing is based on Article 9(2)(b) GDPR. For unsolicited CVs, this notice is provided at the first suitable contact following their submission and no consent is required for the processing of the data they contain (Section 111-bis of the Italian Data Protection Code). If the candidate is hired, the data will become part of the employee file and will be processed in accordance with the relevant notice.

4.4 Requests concerning personal data

Through the “Privacy request” form, the following data are collected: first name, surname, e-mail address and type and content of the request, processed in order to respond to the data subject and to document the handling of the request. Information verifying identity may be requested where there are reasonable doubts as to the identity of the person making the request (Article 12(6) GDPR).

4.5 Cookies and third-party services integrated into the Website

The Website uses technical cookies and, subject to consent, third-party cookies and tools for statistics and for displaying embedded content (for example the Google Maps map on the “Contacts” page). Details are set out in the Cookie Policy, accessible from the banner and from the footer of the Website.

The Website contains links to VoiSmart’s profiles on LinkedIn, Instagram, Facebook and YouTube. These are simple links which do not transmit any data to the social networks until the user clicks on them; on those platforms the notices of the respective operators apply. The Website is also connected to Google Search Console in order to monitor its indexing: that tool does not install cookies on visitors’ devices.

5. Processing methods

The data are processed using IT and electronic tools, by authorised and instructed personnel, applying technical and organisational measures that are appropriate pursuant to Article 32 GDPR, within the framework of the ISO/IEC 27001 certified information security management system. No automated decision-making, including profiling, producing legal effects concerning data subjects or similarly significantly affecting them is carried out (Article 22 GDPR).

6. Recipients of the data

The data may be disclosed to:

  • VoiSmart personnel authorised to process the data (Article 29 GDPR and Section 2-quaterdecies of the Italian Data Protection Code), within the limits of their respective duties;
  • suppliers that process the data on behalf of VoiSmart as data processors (Article 28 GDPR), including: Website hosting and maintenance services (Hetzner Online GmbH), e-mail (Zextras S.r.l. – Carbonio) and the provider of the statistics tools identified in the Cookie Policy;
  • parties acting as independent data controllers, including Google in respect of the Google Maps map embedded in the “Contacts” page, which is loaded only subject to consent; the operators of the social networks in respect of the profiles reachable through the links on the Website; and the consultants and professionals who assist VoiSmart in the performance of their respective professional obligations;
  • public and judicial authorities, where provided for by law.

An up-to-date list of the data processors is available on request at the contact details given in section 1. The data are not disseminated to the public.

7. Transfers of data outside the European Economic Area

Certain third parties whose services are integrated into the Website, in particular Google, may process data outside the European Economic Area, in particular in the United States. In such cases the transfer takes place on the basis of the European Commission’s adequacy decision on the EU-U.S. Data Privacy Framework, for certified providers, or of the standard contractual clauses approved by the European Commission (Article 46 GDPR).

8. Rights of the data subject

The data subject may at any time exercise the rights provided for by Articles 15 to 22 GDPR: access, rectification, erasure, restriction of processing, data portability and objection to processing based on legitimate interest. The data subject may also withdraw at any time the consent given for cookies and third-party tools, without affecting the lawfulness of processing carried out before the withdrawal.

Requests may be sent to privacy@voismart.it or submitted through the “Privacy request” form on the Website. VoiSmart replies within one month of receipt; that period may be extended by two further months in the case of complex or numerous requests (Article 12(3) GDPR).

The data subject also has the right to lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali, www.garanteprivacy.it) or with the supervisory authority of the Member State in which he or she resides or works, or in which the alleged infringement occurred (Article 77 GDPR).

9. Minors

The Website is addressed to professionals, businesses and organisations and is not intended for persons under 18 years of age. VoiSmart does not knowingly collect data relating to minors; should this occur, the data will be deleted.

10. Changes to this notice

VoiSmart may update this notice, including as a result of changes in legislation or to the Website. The version in force is always published on this page, together with the date on which it was last updated.
